Can I Apply for EB-1A If I’m Not Currently in the U.S.?

Apply For EB-1A If Iâm Not Currently In The U.s

The EB-1A visa, also known as the “Einstein Visa” or “Extraordinary Ability Green Card,” is a highly sought-after path to permanent residency for individuals with exceptional achievements in the sciences, arts, education, business, or athletics. But what if you’re not currently in the United States? Can you still apply for this prestigious visa category?

The short answer is yes. Unlike some other employment-based green card categories, you do not need to be physically present in the U.S. to apply for an EB-1A. In fact, applying from abroad can offer some distinct advantages.

The EB-1A Eligibility Criteria

First, let’s review the basic eligibility criteria for the EB-1A visa. To qualify, you must demonstrate that you have extraordinary ability in your field, which means you’re one of the small percentage of individuals who have risen to the very top of your profession.

You can prove this by either showing evidence of a one-time achievement (such as a Nobel Prize, Oscar, or Olympic medal) or by meeting at least three out of the ten criteria outlined by U.S. Citizenship and Immigration Services (USCIS). These criteria include:

  1. Receipt of nationally or internationally recognized prizes or awards for excellence
  2. Membership in associations that require outstanding achievement
  3. Published material about you in professional or major trade publications or other major media
  4. Participation as a judge of the work of others in your field
  5. Original scientific, scholarly, artistic, athletic, or business-related contributions of major significance
  6. Authorship of scholarly articles in professional journals or other major media
  7. Display of your work at artistic exhibitions or showcases
  8. Performance in a leading or critical role for distinguished organizations
  9. High salary or other significantly high remuneration compared to others in your field
  10. Commercial successes in the performing arts

Meeting these criteria requires substantial documentation of your achievements and recognition in your field, whether you’re applying from within the U.S. or abroad.

Advantages of Applying for EB-1A from Outside the U.S.

So why might you choose to apply for an EB-1A from outside the United States? There are a few key advantages:

  1. No need for a U.S. job offer or employer sponsorship. One of the major benefits of the EB-1A is that it allows for self-petitioning. This means you don’t need a U.S. employer to sponsor your green card application. You can apply on your own merits, based on your extraordinary achievements. This can be especially appealing if you’re not yet ready to make the move to the U.S. or if you want to keep your career options open.
  2. Avoid the need for a nonimmigrant visa. If you’re not currently in the U.S., applying for an EB-1A from abroad means you can skip the step of obtaining a nonimmigrant visa (such as an H-1B or O-1) before pursuing permanent residency. This can save you time and hassle, especially given the competitive and uncertain nature of the H-1B lottery system.
  3. Potentially faster processing times. Once your EB-1A visa petition is approved by USCIS f, your immigrant visa will be processed by a U.S. consulate or embassy in your home country. In some cases, this can lead to faster processing times compared to adjusting status from within the U.S., where you’re subject to USCIS processing backlogs. However, processing times can vary widely depending on the consulate and the complexity of your case.

The Consular Processing Path

If you choose to apply for an EB-1A from outside the U.S., you’ll go through a process called “consular processing.” Here’s a basic overview of the steps:

  1. File your Form I-140 petition with USCIS. This is the basic petition for EB-1A classification, where you’ll provide evidence of your extraordinary ability and acclaim.
  2. Wait for your petition to be approved. USCIS will review your petition and supporting evidence to determine if you meet the EB-1A criteria. If approved, your case will be forwarded to the National Visa Center (NVC).
  3. Submit required documentation to the NVC. The NVC will request additional documentation, such as your DS-260 immigrant visa application, passport information, and civil documents.
  4. Attend your visa interview. Once your documentation is complete, the NVC will schedule your visa interview at a U.S. consulate or embassy in your home country. During the interview, a consular officer will review your case and determine your eligibility for the EB-1A visa.
  5. Enter the U.S. as a permanent resident. If your visa is approved, you’ll receive a passport stamp allowing you to enter the U.S. as a lawful permanent resident. Your physical green card will be mailed to your U.S. address shortly thereafter.

A Note on Visas for Family Members

If you’re applying for an EB-1A from outside the U.S., your spouse and unmarried children under 21 can also apply for derivative visas to join you in the United States. They’ll need to submit separate visa applications and attend their own interviews, but they can do so concurrently with your EB-1A application.
